Darüber hinaus bitten wir die folgen- den ergänzenden Anmerkungen bei den weiteren Beratungen über den Richtlinien- entwurf zu berücksichtigen. Andere Rechnungsformate müssen möglich bleiben In der Automobilindustrie werden strukturierte elektronische Nachrichten bereits seit vielen Jahrzehnten ausgetauscht. Die aktuellen VDA-Empfehlungen zum Rech- nungsdatenaustausch 4938 und 4983 basieren auf einem Datenmodell, das mit Ver- tretern der europäischen, amerikanischen und japanischen Automobilindustrie im Rahmen des Joint Automotive Industry Forums entwickelt und abgestimmt wurde und wird.

However, this will limit the flexibility to use the same packaging for different products. The huge variety of products/spare parts in the Automotive Industry sometimes demands the use of standardized packaging in order to prevent a great amount of investments into differ- ent tools and print clichés on the side of the packaging manufacturer. …1 VDA-Anmerkungen zur Überarbeitung des Zollkodex der Union Wir bedanken uns für die Möglichkeit, den Vorschlag der Europäischen Kommission1 zur Re- form des EU-Zollkodex kommentieren zu können. Wir unterstützen die vom Bundesverband der Deutschen Industrie (BDI) eingereichte Stellungnahme, an deren Erstellung der VDA mit- gewirkt hat. Darüber hinaus möchten wir aus Sicht der deutschen Automobilindustrie auf fol- gende Aspekte noch einmal gesondert hinweisen und bitten diese Anmerkungen im weiteren Gesetzgebungsprozess zu berücksichtigen.

Definition des Einführers In der UZK-Reform wird die Person des Einführers legaldefiniert. Nach unserer Auf- fassung wird der Einführer meist mit dem Zollanmelder übereinstimmen. Dies ist ins- besondere sinnvoll, da die Zollschuld zukünftig (auch im Regelfall) bei der Person des Einführers entsteht. Daher könnte in der Definition des Einführers in Art. 5 UZK ergänzt werden, dass die Abgabe der Importzollanmeldung im eigenen Namen und auf eigene Rechnung die Eigenschaft des Einführers indiziert. Dies kann Ausle- gungsschwierigkeiten proaktiv vermeiden. 3. Trust & Check-Trader Der Trust & Check-Trader (nachfolgend T&C) soll von einer Vielzahl an Vorteilen in der Zollabwicklung profitieren.

Übermittlung z.B. des Buchführungssystems, Geschäfts- und Beförderungsunterlagen und Warenverfolgung- und Logistiksysteme (Art. 25 Abs. 3 Buchst. f) bitten wir um Berücksichtigung der folgenden Aspekte: o Die angeforderten Informationen betreffen die „Kern-Daten“ der Unterneh- men. Diese sensiblen Daten können nur unter hohen IT-Sicherheits-/Daten- schutzstandards zur Verfügung gestellt werden. Die Aussetzung der Vollziehung ist aktu- ell ohne Sicherheitsleistung nur dann möglich, wenn der Wirtschaftsbeteiligte dadurch wirtschaftliche Schwierigkeiten erleiden würde.

Da ein T&C aber gerade die gesicherte wirtschaftliche Lage im Rahmen des Monitorings/Antragsstellung nach- weisen muss, führt diese Voraussetzung dazu, dass ein T&C faktisch von der Mög- lichkeit der Befreiung von der Sicherheitsleistung ausgenommen wird. Dies stellt eine Schlechterstellung dar, die dem T&C doch gerade nicht drohen sollte. Daher bitten wir diesen Vorteil in Art. 25 Abs. 7 UZK zu ergänzen. 4. EU-Customs-Data-Hub Auch beim EU-Custums-Data-Hub bitten wir ein besonderes Augenmerk auf die IT- Sicherheit und den Datenschutz zu legen. Darüber hinaus ist eine praktikable Abfra- gemöglichkeit des Wirtschaftsbeteiligten, welche Daten von ihm gespeichert sind, sehr wünschenswert.

T&C-Trader- Bewilligung Die aktuellen Zollverfahrenserleichterungen aus dem UZK, die keine AEO-Bewilli- gung erfordern, sollten auch in Zukunft ohne weitere Bewilligung (sei es AEO oder T&C) möglich sein. Hier haben wir insbesondere das Anschreibeverfahren aus Art. 73 Abs. 3 Buchst. a) im Blick – dies sollte auch ohne AEO-Bewilligung möglich sein, sofern die materiellen Vorrausetzungen eingehalten sind.

Vorübergehende Verwahrung Nach unserer Interpretation sieht der Entwurf vor, dass für die Nutzung der Vorüber- gehenden Verwahrung zukünftig eine Zolllager-Bewilligung benötigt wird, die Ware aber nicht ins Zolllagerverfahren zu überführen sind (Art. 86 Abs. 3 UZK). Wir sehen in einer solchen Verknüpfung der Vorübergehenden Verwahrung mit einem besonde- ren Zollverfahren eine vermeidbare Komplikation in der operativen Zollabwicklung. Die aktuellen Verwahrlager-Regelungen haben sich vielmehr bewährt. Besonderes Augenmerk sollte auf die Dauer der Vorübergehenden Verwahrung gelegt werden: Die Reduzierung von 90 Tagen auf 3 bzw. 6 Tage sehen wir in der operativen Ab- wicklung sehr kritisch (Art. 86 Abs. 5 UZK). Gleichwohl können wir nachvollziehen, dass die aktuelle…

Aufzeichnungen für Besondere Zollverfahren Eine lückenlose Dokumentation des Warenwegs ist unerlässlich für ein Monitoring der Compliance-Vorschriften des jeweiligen Besonderen Zollverfahrens. Gleichwohl sehen wir es als ausreichend an, wenn die entsprechende Dokumentation durch den Bewilligungsinhaber und (weil meist Personenidentität gegeben ist) Einführer bzw. Ausführer geführt werden. Weitere am Prozess nur „nachgelagert“ beteiligte Perso- nen sollten nicht eine „zweite“ Aufzeichnungspflicht haben. Dies führt u.E. zu ver- meidbarem Bürokratieaufwand aufseiten der Wirtschaftsbeteiligten. Insoweit sollte der Personenkreis in Art. 104 UZK reduziert werden. 8.

Sanktionen Die Vereinheitlichung der Sanktionen sehen wir gerade vor dem Ziel des „Act-as- One“-Gedanken als sinnvoll an. Gleichwohl ist uns aufgefallen, dass aktuell nach un- serer Lesart auch bei schlichten Arbeits- bzw. Flüchtigkeitsfehlern zwingend Sanktio- nen zu verhängen sind, weil kein Ermessen in Art. 254 UZK eingeräumt wird. Da die Zollanmeldungen jedoch für unsere Mitglieder ein Massengeschäft darstellen mit mehreren tausend Positionen pro Tag, sind (sehr vereinzelte) Arbeitsfehler in der Praxis nicht auszuschließen. Bei einem solchen Einzelfehler, der meist auch proaktiv gegenüber der Zollbehörde berichtigt wird, zwingend eine Sanktion zu fordern, ist u.E. nicht notwendig bzw. nicht verhältnismäßig und steht auch im Widerspruch zu einer offenen „Fehlerkultur“.

Pallet wrappings and straps, which are used on pallets as well as all types of load carriers, are essential for the industry, ensuring consistent quality, and reliable product protection while serving as a key element of load securing that significantly contributes to road safety.

We consider it unnecessary to impose a reuse quota for pallet wrappings and straps, as these materials present no ecological concerns. Both are mono-material solutions, fully recyclable, and already incorporate a significant proportion of recycled plastics. Furthermore, pallet strappings and wraps are globally established standards in packaging, and any shift towards reusable systems would significantly increase complexity across the supply chain. This would result in an immense amount of bureaucratic effort and jeopardize the competitiveness of European companies. Moreover, there is currently no other technology available that can ensure maximum transport security and the highest flexibility for diverse applications while using a minimal amount of material.
