The German Bar Association (Deutscher Anwaltverein DAV) welcomes the opportunity to participate in the public consultation on the simplification package in environmental legislation, notably with regard to the proposal on speeding-up environmental assessments. Whilst the DAV welcomes the European Commissions objective of streamlining and accelerating environmental assessments, it emphasizes in its position paper that this objective should not come at the expense of legal protection. Lengthy proceedings are caused predominantly not by the provisions governing environmental assessments as such, but rather by the inadequate enforceability of substantive legal provisions, insufficient…
