BACKGROUND The troublesome concerns the difficulties that producers of containers made of ceramic have found in the implementation of the European Directive of Packaging and Packaging waste1 which forces ceramic food containers to be adhered to a “Return, Collection and Recovery System”,2 although they cannot be associated with the concept of packaging waste.

That obligation is a consequence of the lack of European Union (EU) harmonisation disregard the fact that ceramic is a non-polluting material and that it would not be economically reasonable to implement an individual collection and treatment channel; therefore, an important fee is being paid in some European Union countries for a non-effective service that, additionally, cannot be put in place. Ceramic food containers have some characteristic features that differentiate them from the rest of food packaging. As it is an inert material, it implies no risk for natural sources like water and soil, neither for human health, animals and plants.

Another of the reasons why ceramic is so friendly with the environment is its endurance, which makes it a long-lasting product that consumers are willing to keep (between 75% and 95% of the cases) and not get rid of: as a result, it helps avoiding packaging waste. Ceramic food containers are designed and manufactured to be genuinely marketed as packaging, kitchenware or tableware.

In this sense, ceramic food containers can easily integrate our houseware given the fact: they generate no unwanted smell and can resist relevant temperature changes (they can be used in the oven, freezer and microwave); for these reasons, ceramic food containers’ usefulness finds no threshold since they can be reused as kitchenware or tableware - one of the original purposes for which they are designed and manufactured - multiple times by way of a simple washing and drying, being the reason why they do not end in landfill.

Such attributes meet The European Green Deal’s purposes by which the European Commission (EC) has committed to lead a global change and leave a better Planet to the next generations by turning Europe into a more competitive economy through a more efficient use of the Planet’s resources.4 Throughout said strategy, the EC reflects the necessity of reducing waste and over-packaging so as to achieve a sustainable development.

In this regard, it seems difficult to find some other material, for packaging purposes, more suitable than ceramic to achieve the European Green Deal’s goals. Under the Directive 94/62 on Packaging and Packaging waste, packaging can be managed by alternative systems. Two of them are: Packaging Integrated Waste Management System and Deposit and Return System. In the first, the management system is in charge of their pick-up, transportation, storage and recycling (whether it is feasible). Such mechanism is funded by packaging fillers who pay an amount based on the quantity of packaging waste they put in the market, in compliance with the “polluter-pays principle”.

By means of the Deposit and Return System, a deposit fee is refunded to consumer once the item has been properly returned. Although European Union (EU) has been fully committed with the environmental impact of packaging waste since the Directive 94/62 was adopted, there is still a lack of harmonisation among national regulations, particularly with an inefficient management of ceramic food containers waste since there is no specific container where they can be placed and no recycling process is foreseen; this means that the aim of the European Green Deal and European Directives are not being addressed.

Such a lack of harmonisation is also against the common goals and schemes proposed by the EC Circular Economy Action Plan,6 that will attempt to homogenise treatment and recycling channels once consumers get rid of packaging. In compliance with this, the Circular Economy Action Plan encourages to standardise and set up separate recycling systems. The impact of said lack of harmonisation in the EU Single Market is particularly dramatic in France given the eventual amount to be disbursed by ceramic food containers fillers to the Packaging Integrated Waste Management System, called CITEO (a company emerging from former Éco-emballage).

This unbearable fees increase harms ceramic food fillers (which are potentially being forced to switch into other packaging materials, cheaper but more contaminant ones) and containers producers (which are being excluded from the market). CERMER, which has been manufacturing earthenware containers for the last 30 years, is suffering this situation despite it is the one that consumes the least amount of energy during firing and the one that could most easily be decomposed and recycled among the ceramic materials. Under no circumstances should the economic implications of this situation be bypassed since the food ceramic sector is such a remarkable one, being led at a European level by Spain (mostly earthenware developed in the Valencian region, particularly by CERMER).

All those described circumstances are contrary to the EU Single Market objectives and put this industrial branch into financial trouble, given the fact that, only for CERMER, the French market represents 30% of its total business. CERAMIC FOOD PACKAGING WASTE’S LEGISLATIVE CONTEXT With the aim of harmonising national measures within the EU regarding the management of packaging and packaging waste, so as to prevent their generation or at least significantly reduce it, the European Parliament and the Council adopted the Directive 94/62. …24-12-20 BAJO IMPACTO MEDIOAMBIENTAL DE LAS MATERIAS PRIMAS UTILIZADAS EN CERMER Las materias primas utilizadas para la fabricación de los envases cerámicos, se pueden clasificar en dos grupos principales: - Arcillas rojas/blancas - Esmaltes cerámicos Podemos indicar que la proporción de arcilla en el envase cerámico es de un 95% frente a un 5% de esmalte, en relación al peso final del envase (aproximadamente). ARCILLAS La arcilla es un material natural compuesto fundamentalmente por minerales de granulometría fina, que presenta generalmente un comportamiento plástico con contenidos apropiados de agua y que endurece tras el secado o la cocción.

En términos comunes, las arcillas son materiales naturales muy repartidos en la superficie de la corteza terrestre y que, en ocasiones, pueden formar, al ser mezclados con agua, masas plásticas a partir de las cuales es factible fabricar productos cerámicos. La composición en óxidos de las arcillas utilizadas en CERMER está formada mayoritariamente por SiO2, Al2O3, Fe2O3, CaO, MgO y K2O. Las arcillas también presentan en composición otros óxidos en un porcentaje menor de un 1% como el Na2O, TiO2, MnO, P2O5 y BaO. La extracción de las arcillas se realiza en explotaciones a cielo abierto, con un menor impacto medioambiental que otro tipo de minería asociada a la extracción de otras materias primas con fines industriales.

Indicar que las arcillas al ser un producto muy abundante en la corteza terrestre, no está considerada como una materia prima crítica y por lo tanto no se encuentra en la Lista de materias primas críticas publicada por la UE. ESMALTES Un esmalte cerámico es una suspensión formada por fritas cerámicas, materias primas, aditivos y pigmentos cerámicos. Los esmaltes se aplican sobre la superficie del envase cerámico y tras la cocción confieren una capa impermeable, protectora y decorativa proporcionando al envase sus belleza y características técnicas específicas. Los esmaltes utilizados en la fabricación de los envases cerámicos de CERMER, son esmaltes no contaminantes para el medioambiente y no tóxicos para el ser humano.

En cuanto a la composición de nuestros esmaltes, comentar que se caracterizan por: - ausencia de plomo, cadmio, mercurio, selenio y cromo hexavalente; - muy baja concentración de otros metales pesados. Ares(2021)116519 - 06/01/2021 24-12-20 Teniendo en cuenta esto, nuestros envases cumplen de manera totalmente satisfactoria todas las normativas de seguridad alimentaria y de residuos de envases, en cuanto al contenido y la migración de elementos tóxicos. Además si consideramos el bajo porcentaje de esmalte aplicado en un envase respecto al peso total del mismo, es de esperar que el impacto que pueda presentar en un vertedero es muy bajo, ya que la mayor parte de nuestro envase es arcilla, producto natural.
