Sustainable production and the use of sustainable packaging is of key importance for the German confectionery industry. Hence the confectionery sector is constantly deliberating sustainable ways of handling water, energy, waste, and logistics, and is thus also focussed on the eco-friendliness of the packaging used and the conservation of resources. Since the introduction of the German Packaging Ordinance in 1991, German confectionery manufacturers have been continuously reducing the amount of packaging material used. The German Association for Packaging Research (GVM) has calculated: if Germany had stayed with the packaging of 1991, instead of going on to use state-of-the-art plastic packaging in 2013, then - this would have generated 955 kilo tonnes more plastic and - this would have resulted in approx. 2.6 (2.5-2.8) million tonnes more of CO2 emissions. The key focus is on sourcing sustainable raw materials for confectionery production itself, such as sustainably produced cocoa; but sustainable production and the use of sustainable packaging is also of key importance. In Germany, approx. 49% of the plastic waste is thermally recovered and approx. 51% is materially recovered, i.e. recycled. According to the German Packaging Act, the recycling rate for plastic packaging came to 58.5% in 2019 and is expected to increase to 63% in 2022. This means that as early as in 2019, Germany’s recycling rate for plastic packaging is expected to exceed the Europe- wide target of 55% in 2030 as laid out in the EU Packaging Directive. Both the European Plastics Directive (SUP – Single Use Plastics Directive) and the German Packaging Act require packaging to be recyclable.

Zentrale Änderungen ergeben sich durch die Einführung eines EU Customs Data Hub, in dem Zolldaten über eine EU‐Zolldatenplattform übermittelt werden sollen. Eine europäische Zollbehörde mit eigenem Budget und Personal soll geschaffen werden. Ein neuer Status für Unternehmen, ein sogenannter Trust & Check‐Trader soll Unternehmen befähigen, insbesondere Einfuhrprozesse selbstständig und einfacher durchführen zu können.

Aufgrund immer mehr administrativer Anforderungen bei den Unternehmen, müssen bei dieser grundlegenden Zollreform tatsächliche Erleichterungen für im‐ und exportierende Unternehmen bereits mitgedacht werden.  Verfahren und Bewilligungen im Export gehören auf den Prüfstand Die zoll‐ und außenhandelsrechtlichen Prozesse sind teilweise von enormer Komplexität geprägt. Ein Bespiel bildet hier etwa das Verfahren der aktiven Veredelung. Die Reduktion der Komplexität bei Beantragungen von Bewilligungen und in den Abläufen würde alle Unternehmen entlasten. Im Falle von KMU würde eine Komplexitätsreduktion teilweise erst die Teilhabe an bestimmten Zollverfahren ermöglichen. Besonders für KMU stellt sich daher die Frage nach grundsätzlichen Vereinfachungen von Zollverfahren.

B. 500 t) von einer Bewilligung ganz abgesehen wird.  Eine weitere Verfahrenserleichterung könnte durch eine Digitalisierung der bisher üblichen und Papier basierten Prozesse bei der Warenverkehrsbescheinigung A.TR. für die Türkei erzielt werden.  Bei Ausfuhrverfahren von dringenden Sonderausfuhren, die nicht Teil der Bewilligung sind, würden z. B. verkürzte Gestellungszeiten für zuverlässige Ausführer zu effizien‐ teren Prozessen in den Unternehmen führen (z. B. von 24 Stunden auf 12 Stunden bzw. Öffnungszeiten des Ausfuhrzollamtes). Ref.

Ausgehend ihrer dort einzugebenden Stammdaten, könnten sie unmittelbar neue Bewilligungsanträge oder andere Formulare erstellen.

Daten in unterschiedlichen Systemen. Die Lebensmittelüberwachung greift über das System TRACES bspw. auf Gesundheitseingangsdokumente zu, die Zollämter auf ATLAS und das EU‐Trader‐Portal. Aus Unternehmenssicht sind Prozessoptimierungen für Ein‐ und Ausfuhrabfertigungen dringend erforderlich. Unter dem Stichwort „Single Window“ wurde in der EU bereits die Verknüpfung ver‐ schiedener Portale für die unterschiedlichen Behörden sowie für die Unternehmen diskutiert. Konkret fallen darunter z. B. die Plattformen TRACES, ATLAS, EU‐Trader‐Portal. Aus Sicht der Unternehmen wäre es eine klare Verbesserung, wenn in einem einzigen Portal die wesent‐ lichen Dokumente und Anforderungen für Im‐ und Exportvorgänge zusammenfließen.

Dies kann zum Beispiel Art und Umfang von Datenübermittlung betreffen. Unterschiedliche Handhabungen zeigen sich oft nach einem neuen ATLAS‐Release. Besonders für Unternehmen, die mit verschiedenen Zollstellen zusammenarbeiten, wird die Arbeit dadurch zusätzlich erschwert. Eine Harmonisierung der Umsetzung und Handhabung in den Zollstellen und besonders zwischen den Mitgliedsstaaten wäre daher sehr erstrebenswert.

Er ist sowohl Wirtschafts‐ als auch Arbeitgeberverband. Die deutsche Süßwarenindustrie ist mit einem Anteil von etwa 10 % am Umsatz die viertgrößte Branche der deutschen Ernährungsindustrie. Ihr besonderes Kennzeichen ist ihre starke Export‐ orientierung. Die deutschen Süßwarenhersteller beschäftigen rund 60.000 Mitarbeiter. Im BDSI sind sowohl die großen, international tätigen Unternehmen der Süßwarenindustrie organisiert, aber gleichzeitig vor allem auch sehr viele kleine und mittelständische Unternehmen.

Die deutsche Süßwarenindustrie setzt sich für einen vorausschauenden und effizienten Umgang mit den erforderlichen Ressourcen ein und begrüßt und unter- stützt die Bestrebungen zum Übergang zu einer gut funktionierenden Kreislaufwirtschaft. Bei allen Bemühungen der Industrie darf aber nicht vergessen werden, dass es zum Erreichen einer wirklich funktionierenden Kreislaufwirtschaft der Anstrengungen der gesamten Wertschöpfungskette bedarf, vom Hersteller über die Sammel- und Sortier- bis hin zu den Recyclingsystemen. Schließlich können auch die Verbraucher dabei helfen, die Stoffströme zu schließen, indem sie Verpackungen richtig – getrennt – entsorgen und v. a. nicht achtlos in die Umwelt werfen. Eine Förderung der wirksamen Zusammenarbeit zwischen allen Akteuren der Verpackungs- wertschöpfungskette ist damit unerlässlich.

Unsere Anmerkungen zu den Plänen der Verpackungsverordnung im Einzelnen: Recyclingfähigkeit Investitionen in den Ausbau der Sortier- und Recyclinginfrastruktur erforderlich Die Recycelbarkeit einer Verpackung entscheidet sich nicht alleine am Design-for- Recycling: damit alle theoretisch recyclingfähigen Verpackungen auch tatsächlich recycelt werden, sind zusätzlich zum Design einer Verpackung Investitionen in den Ausbau der Sortier- und Recyclinginfrastruktur erforderlich: hier bieten sich z. B. Quoten und/oder Standards auch für Sortieranlagen an, um alles recyclebare Material aus der Müllsammlung zu sortieren, um es dann den Recyclinganlagen zur Verfügung zu stellen.

Hier ist ein EU- einheitlicher Ansatz erforderlich, da dies bisher in den einzelnen EU-Mitgliedstaaten sehr unterschiedlich gehandhabt wird. Bei der Bewertung der Recyclingfähigkeit einzelner Materialien muss immer beachtet werden, dass alternative, vermeintlich recyclingfähigere Verpackungsmaterialien wirklich nachhaltiger sind als die Materialien, die sie ersetzen sollen. Durch die Festlegung von D4R-Kriterien und die damit verbundene Konformitätserklärung befürchten wir eine hohe administrative Belastung für die betroffenen Unternehmen, mit den damit verbundenen hohen Kosten – hier bitten wir um eine genaue Folgenabschätzung und eine verhältnismäßige und angemessene Regelung. Administrative Zusatzbelastung und Übergangsfristen Auch beim Rezyklateinsatz sind wir besorgt über die administrative Zusatzbelastung und die damit verbundenen Kosten. Die vorgesehene Frist zum Reagieren der Hersteller ab dem Vorliegen einer Berechnungsmethode (2027) bis zur Umsetzung der Rezyklateinsatziele (2030) ist zu kurz.

Minimierung von Verpackungen Keine Kompromisse bei der Lebensmittelsicherheit Wenn Verpackungen verpflichtend minimiert werden müssen, so muss dies immer vor dem Hintergrund geschehen, dass die Lebensmittelsicherheit immer an erster Stelle stehen bleiben muss und dass alternative, leichtere oder weniger Verpackungsmaterialien wirklich insgesamt nachhaltiger sein müssen als die Materialien, die sie ersetzen sollen. Sonst macht die Verpackungsminimierung keinen Sinn. Die vermeintlich einfache Lösung ist in vielen Fällen nicht die wirklich nachhaltigere.
